Design Works Giveaway!

1. Entry: No purchase is required to enter "Design Works Giveaway!" (the “Giveaway”). An entrant may enter the Giveaway by either: (i) completing the official on-line registration at www.capecoddesignworks.com; or (ii) to enter by mail, print the online registration form and mail to: Design Works 159 Main Street Yarmouthport, MA 02675 Attention: Design Works Giveaway. There is no cost to register. Only one email address per individual is allowed. To be eligible to win the Giveaway all entries, both via email or postal mail, must be received by 11:59 pm EST on December 1, 2006. Upon entry for the Giveaway each entrant agrees to be bound by these Official Giveaway Rules.

2. Giveaway Participants: The Giveaway is open to all legal residents of the United States and Canada who are 18 years of age or older. The Giveaway is not open to: (i) employees of the Design Works, (the “Sponsor”), its agents, affiliates, subsidiaries and members of their immediate families or persons residing in the same household of such employees; or (ii) agents, dealers, advertising and promotional agencies or any other party engaged in the development, production and/or distribution of materials relating to the Giveaway. Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or stolen, delayed, illegible, incomplete, damaged, misdirected, or lost entries. Sponsors reserve the right, in its sole discretion, to cancel the Giveaway for any reason. In the event that the Giveaway are cancelled, the Sponsors reserve the right to award, at its discretion, prizes to eligible, non-suspect, entrants that submitted entries prior to the date of cancellation. The use of automated entry devices or any other conduct which impedes the integrity of the Giveaway is prohibited. In the event of a dispute, an entry will be deemed made by the holder of an established e-mail account associated with the entry. Upon entry, all registration or entry forms become property of the Sponsors.

3. Prizes: Subject to these Official Giveaway Rules, the following three prizes (collectively, the “Prizes”) will be awarded under the Giveaway on November 1, 2006; November 15, 2006; December 1, 2006, a Fifty-dollar gift card redeemable at Design Works. Each Prize will be award to one entrant that submitted an eligible entry between September 26, 2006 and December 1, 2006. A random computerized draw will be held by the Sponsors on or about November 2, 2006; November 16, 2006; December 2, 2006 for the prizes. Winners will be selected from all valid entries received during the Giveaway. Subject to receiving the applicable documentation as set out in more detail below, a Prize will be delivered by courier or postal to the winner of such Prize within 1 month of the Prize being awarded.

4. Prize Details
No substitutions for cash or otherwise are permitted. Any costs associated with the installation of a Prize will be the sole responsibility of the Prizewinner. The prize must be deliverable and received, signed for by the winner by December 31, 2006.

5. Use of Information
The Winner hereby consents to the Sponsors' use of the Winner’s name, address (city/province only, not specific street address), voice, likeness, photograph and any statements regarding this Giveaway for editorial, public relations, promotional and advertising purposes (in any medium) on behalf of the Sponsors without compensation and without restriction, unless prohibited by applicable law. The Winner will be required to sign a written declaration and a mutually acceptable liability and publicity releases confirming compliance with these Official Giveaway Rules and releasing the Sponsor, its parents, affiliates, subsidiaries and agencies and their respective directors, officers, employees and agents from any and all liability associated with the Prizes. The Winner will be notified by email and must respond with in 10 business days of receipt of notification. The Winner must execute the declaration and release and return such executed documents to the Sponsors within 10 business days of the date the Winner receives such documents. If the Sponsor does not receive the fully executed declaration and release within the prescribed period; Winner shall have forfeited any rights to the Prize and an alternate winner will be chosen.

6. The Sponsor will collect personal information such as contact and demographic information, name, phone, address and email address, provided by persons entering the Giveaway. The Sponsors will use commercially reasonable efforts to store such personal information securely and maintain the confidential nature of such information. Please note that the Sponsor will use personal information in accordance with Sponsor’s Privacy Policies. By entering the Giveaway, the entrant accepts the terms of Design Works Privacy Policy.

General
7. The chances of being selected as a Winner depend on the number of eligible entries received by the Sponsors.

8. The Giveaway is subject to all Canadian and U. S. federal, state/provincial and local laws and regulations and is void where the Giveaway is not permitted or restricted by such laws and regulations. As the Giveaway is only open to legal residents of Canada and the United States it shall be construed and evaluated only in accordance with Canadian and United States law.

9. Each Winner shall be solely liable and responsible for any and all taxes or duties applicable in respect of a Prize.

11. The Sponsor reserves the right at anytime to amend the Official Giveaway Rules and any amendment to the Official Giveaway Rules will be effective as of the date that such amended rules are posted on this website.

12. All decisions made by Sponsor relating to the Giveaway will be final and binding in all matters relating to the Giveaway.

The Giveaway is promoted by Design Works
